On Sunday the Ravens and 49ers will square off in the Super Bowl®.  The Super Bowl is a game of football, but it also represents a lot for brands – the players, teams, and advertisers.

Chipotle is once again running a promotion called the “The Super Big Internationally Televised Professional Football Bowl Game Half Price Party in a Box”. See the ad below – I snapped this photo at my logo Chipotle. The promotion is for this Sunday. Of course, most of the US will be watching the most popular televised event of the year – The Super Bowl – on that date.

My kids love to use the hybrid word “ginormous“. Gigantic + enormous! (believe it or not, the word is actually in the Merriam-Webster Dictionary!)

The word is appropriate for trademark applications with extremely – dare I say impossibly – large descriptions of goods and services.  For example, a recent application contains the listing below, with a claim that the applicant has a bona fide intent to use the mark in connection with each of the services listed. Goods and services listed in this particular application include:

  • abacuses (not abaci?)
  • radio broadcasting
  • life insurance underwriting
  • chemical research
  • legal services
  • night guard services
  • adoption agency services
  • painter’s easels
  • French curves (ed. note: see here)

Such applications – unless they are completely accurate (and who am I to say it isn’t?) pose a major potential harm to the system:

- They affect users of new marks who are searching the USPTO TESS database for potential conflicts;

- They require more resources from the USPTO;

- They make the entire system less efficient

- They make the entire system, by virtue of lower accuracy, less valuable and less productive

One proposal I have, in addition to a general need to clean up the “deadwood” from the register, is to encourage applicants in such situations to file separate applications for each class.  The USPTO could provide an incentive by reducing the filing fees. If the goods and services are spread into multiple applications they are more easily examined and processed by the USPTO, and more easily dealt with and challenged, if appropriate, by other parties.

Love it or Leave it: new American Airlines logo

Last week, American Airlines released a new logo. I think it is a failure.

The old logo was simple. A A and eagle. Because it was simple and the letters are thick, it could be seen and recognized from afar. I’m afraid the new logo may not be clearly visible on a plane outside to those inside an airport terminal.  Plus, the name American Airlines is extremely descriptive, and AA is more unique and protectable.  And the new logo’s “fin” in the middle is not clearly a beak or a tail or a wing. What is it? 

For example, see the airplane image from AA below, it looks red white and blue, but the branding is small, hard to find and not clear.

I think AA could use a brand refresh after all it has been through and having a logo that is decades old. But change should be for the better, not just for the sake of change. I grade this new logo a C-.
