Recent trademark registrations

Here is another sampling of some recent registrations our clients have received from the USPTO, so readers can see real examples of brands and marks which are being protected. (These are all public records – click on trademark name or logo to view USPTO records.)

Multiple “Pelton” trademarks

While a trademark gives some exclusive rights to a name (or logo) for use with a product or service, this does not mean that trademarks cannot overlap or that companies can never use the same name.  Example:  DELTA airlines and DELTA faucets (see also earlier post regarding PHILLIES baseball and cigars).

I did a quick search for brand names using “Pelton” (admittedly, trademarks containing a surname are not as strong as a coined or arbitrary name and are treated differently under the law), and found quite a few!

Notice that each of these in the list has additional wording to help distinguish them or help describe the product/services offered.  And each of the services provided is quite different from the others.  If one was a bed & breakfast and another was a hotel, or one was for toy product and one was for a toy store, they might be more likely to be confused.

It is possible for trademark words to co-exist or overlap, particularly when the name is “crowded” (used by several others) or the term is combined with other wording.  Of course, every situation is unique and if you have a question about using or protecting a particular brand name you should consult an attorney.

Love it or leave it: PHILLIES trademarks

The Phillies logos are great.  First, the PHILLIES name provides a good example or how two brand names can co-exist if the markets and products and services are totally different such that consumers are not likely to confuse the source of the products or services:

            

As I write this, the Phillies are getting ready to face off against the Yankees in Game 6 of the World Series.  I’m a Red Sox fan since birth, so that means I’m rooting for the Phillies.  The Philadelphia Phillies is a great trademark and they have a great set of logos.  Phillies is, I presume, a made up word which is created from the word Philadelphia and its nickname Philly (i.e. Philly Cheesesteak).

The name is very suggestive therefore of a team from Philadelphia.  The current logo including the liberty bell, cracked and all, the shape of a baseball field, and the word “Phillies” in a fun script font using stars to dot the “i”s, a subtle reference to Philadelphia’s place in American history.  The Phillies also use a stylize “P” logo with a baseball forming the circle inside the “P.”  The logos are playful, and connect to the team name and the city of Philadelphia and the sport – perfect for a sports team.

Tip: Sometimes more than one logo are relevant for your business; they may be used together or separately.  If you have great logos, have you taken steps to protect them?

Trademarks are global… and mobile…

Last week a client needed to sign an electronic filing as a deadline was looming, while he was traveling overseas. The filing was signed electronically via a rented Blackberry!

With the terrific USPTO electronic systems, trademark registrations can be done entirely electronically.  And trademarks have no borders. No matter where a company or business is located, if they have customers in the USA, then US trademark protection is likely a good idea.
