Many trademark firms have not even registered their logos or their brand names. Many do not have slogans, or have not registered them. But I like to practice what I preach.

How many trademark attorneys can say they own 10 US trademark registrations? At least one!  SOFTMWARE® is now registered along with my slogans, brand names (newsletter, website, blog titles, logo, slogan, app name, and more). Of course, quantity is different from quality. More is not necessarily better. But as a trademark attorney advising brand owners to protect their names, logos, slogans and more, I believe it is extremely important that I heed my own advice, and register the brands I create and use.

sofTMware is a free tool for tracking USPTO trademark applications and registrations. It was built from scratch by our firm for use by anyone – via a secure cloud server -  and uses the data published by the USPTO via its recently developed TSDR (Trademark Status & Document Retrieval) API.

Users can track their own trademark applications. They can monitor ones that might be under consideration for opposition. Or monitor the marks of competitors — and see when they file evidence of use and what that evidence looks like. Or just monitor trademark applications that might be interesting. sofTMware can also serve as a docketing backup.

Every morning, the sofTMware software sends out an update of any status changes at the USPTO in the last day. Office actions, responses, registrations, publication, etc. are all possible statuses included in the update. And the update contains an easy and quick link to go right to the USPTO records for each record which shows an update. The updates even display the mark image in case there is a logo or other image involved.

Three online trademark tools

What online trademark tools do you use?   Other than the myriad of resources on USPTO.gov, of course!

Our firm has developed three different free resources for trademark attorneys, paralegals, and owners:

  • Apptorney: IP: a mobile iPhone app for accessing USPTO trademark and patent links (and other government agencies from around the world). Use it to search the USPTO TESS trademark database from your phone in just a few simple clicks.
  • sofTMware: a cloud based website for tracking updates to USPTO application and registration records. You can track your own records, and/or those of your competitors or possible conflicts.

Of course, I am biased…. but I am not aware of any better online trademark tools.  If you are, let me know! If you have suggestions for improving any of these resources, we would love to hear them in the comments below.

On August 25, 2012, the USPTO will release version 2.0 of Trademark Status and Document Retrieval (TSDR). On September 1st, all existing direct (static) hyper-links displaying TARR information will be redirected to TSDR. On September 8th, all existing direct (static) hyper-links displaying TDR information will be redirected to TSDR. Soon thereafter, the web pages at http://tarr.uspto.gov/ and http://tdr.uspto.gov/ will no longer be accessible. Please send any questions to TSDR@USPTO.GOV. Additional information about the TSDR 2.0 deployment is available here:TSDR 2.0.
