Why I Wrote Building a Bold Brand for Small Business Owners

What makes Building a Bold Brand: The Foundations of Trademark Protection different from many books about trademarks and branding?

It comes from two perspectives at the same time.

For more than 25 years, I have helped entrepreneurs and businesses create, register, protect, and grow their trademarks. During those same years, I have also been building a small business and brand of my own.

That combination – trademark attorney and small business owner – shaped nearly every page of Building a Bold Brand.

A Trademark Book Built From Real Small Business Experience

I founded my law firm in 1999 after working as a trademark examiner at the United States Patent and Trademark Office (USPTO).

The beginnings were very small.

I did not have an office. I worked a part-time bartending job at night so that I could reinvest the money I earned practicing law back into the business.

Over time, I built the firm, developed its brand, grew a team, created educational resources, built a significant online presence, and developed and protected trademarks of our own.

At the same time, I was helping thousands of other business owners do many of the same things with their brands.

Today, our firm has helped clients obtain more than 5,000 trademark registrations.

That is the perspective behind Building a Bold Brand. I am not writing only about trademark law in the abstract. The book reflects what I have learned from helping thousands of businesses protect brands while also experiencing firsthand the challenges of creating, marketing, growing, and protecting a small business brand.

What Is Building a Bold Brand About?

Building a Bold Brand is a practical guide to creating stronger brands and protecting them with trademarks.

It is written for business owners, entrepreneurs, brand managers, marketers, and others who want to better understand how trademarks fit into the process of building a valuable brand.

The book covers the full lifecycle of a trademark – from choosing a name through registration, proper use, maintenance, monitoring, and enforcement.

What Will You Learn in Building a Bold Brand?

The book is divided into five parts.

Part One: Launching a Bold Brand

Strong trademark protection begins before a trademark application is ever filed.

The first section explores how to create and select stronger brand names. It covers naming tools, the spectrum of trademark strength, and the importance of searching for potential conflicts before investing heavily in a new name.

The goal is not simply to choose a name that sounds good. It is to choose a brand that can be memorable, distinctive, and protectable.

Part Two: The Trademark Registration Process

The second section explains the federal trademark registration process.

This is an area where my experience as both a former USPTO trademark examiner and trademark attorney provides a particularly useful perspective.

The book explains why trademark registration matters, what happens during the application process, common challenges that applicants encounter, and considerations involved in working with trademark counsel.

The registration process can be complicated, but business owners are in a much stronger position when they understand how it works and why particular decisions matter.

Part Three: Using and Maintaining a Trademark

Obtaining a trademark registration is not the end of trademark protection.

Part Three discusses how trademarks should be used, how trademark symbols work, the importance of monitoring for potential infringement, and the requirements for maintaining and renewing a federal trademark registration.

A strong brand needs continuing attention.

Part Four: Trademark Considerations for Small Businesses and Specific Industries

Trademark strategy is not identical for every business.

The fourth section looks at considerations that may arise for small businesses and in particular industries and professions.

Different businesses may encounter different branding, registration, use, or enforcement challenges. Understanding those differences can help business owners make better decisions about how they build and protect their brands.

Part Five: Trademark and Brand-Building Resources

The final section provides additional tools and resources for business owners who want to continue learning about trademarks and brand protection.

My goal was not merely to explain trademark concepts, but to give readers practical resources they could continue using after they finished the book.

Who Is Building a Bold Brand For?

I wrote Building a Bold Brand primarily for people who are building something.

That includes entrepreneurs launching their first business, established small business owners developing new products or services, marketing professionals working with brand names and slogans, and business owners who already have trademarks but want to understand how to protect them more effectively.

You do not need to be a lawyer to understand the book.

In fact, the purpose is the opposite. I wanted to make trademark concepts understandable and useful for the people making everyday decisions about brands.

What Makes Building a Bold Brand Different?

Three things stand out.

First, the book combines trademark experience with firsthand small business experience. I have spent more than 25 years advising businesses about their brands while simultaneously building and protecting my own.

Second, the book is practical. It includes specific examples, brand stories, trademark examples, and lessons drawn from years of working with real businesses.

Third, it looks beyond filing an application. Trademark protection is connected to naming, marketing, growth, enforcement, renewals, and long-term brand value. The book is designed to help business owners see that bigger picture.

Why Trademark Protection Matters When Building a Brand

A brand can represent years of work, customer goodwill, marketing, reputation, and investment.

Trademark protection helps a business identify and protect the names, logos, slogans, and other indicators that distinguish it from competitors.

That is why I believe trademark strategy should be part of building a brand from the beginning rather than something a business thinks about only after a problem arises.

The strongest brands are not only creative and memorable. They are built with protection in mind.
